Perform 72 Privacy Policy
This policy explains how P72 Sports Limited, trading as Perform72, handles personal information through our website and golf performance and coaching services, including optional connections to Garmin and other supported services.
It also explains your choices and rights. Reading this policy or accepting our terms does not itself give consent to optional health-data processing.
1. Who We Are and How to Contact Us
P72 Sports Limited is the controller for the personal information we use to operate Perform72.
We are registered in England and Wales under company number 15756655. Our registered office is 7 Hewell Road, Barnt Green, Birmingham, England, B45 8NG.
For privacy enquiries, rights requests or consent withdrawal, email info@perform72.com.
You may also write to our registered office, marked Privacy Request.
Our Managing Director is Jeff Ogden; business contact details are jeff.ogden@perform72.com and +44 7465 822919.
2. Information We Collect and Its Sources
Account and contact information includes your name, email, date of birth, gender, contact details, account credentials and preferences. We collect information you provide when registering, using the service or contacting us.
Golf and coaching information includes scores, practice statistics, assessments, plans, swing analysis, fitness information and material supplied through your coaching relationship. Information may come from you, your selected coach or a service you authorise to connect.
Technical information includes IP address, device type, operating system and usage information associated with use of the website or app. We also keep permission and consent records and information needed to manage optional account connections.
Connected-service information comes from services you choose to authorise, which may include Garmin Connect, WHOOP, Apple HealthKit and ARCCOS where supported. The information received depends on the enabled integration, your device and your permissions. We do not request the password for your Garmin account.
3. Why We Use Your Information
We use information to create and manage accounts, provide player records and coaching features, show progress and performance trends, support improvement plans, answer requests, maintain security and meet legal obligations.
Optional health information is used only for the health and preparation purposes explained in section 5 and the consent request.
Information needed to provide a requested account or feature is required for that feature to work.
Optional connections, health-data processing and marketing choices are separate; declining them does not prevent you using unrelated Perform72 features.
4. Our lawful bases
We rely on contract, Article 6(1)(b), for information objectively necessary to provide the services you request.
We rely on legitimate interests, Article 6(1)(f), for proportionate account security, fraud prevention, support and service administration, after considering your rights.
Legal obligations, Article 6(1)(c), apply where law requires processing.
Consent, Article 6(1)(a), applies to optional connected health-data processing.
Where information reveals your health, we also rely on explicit consent under Article 9(2)(a).
Contract or legitimate interests alone does not authorise that health-data use.
Consent for health processing, coach sharing and marketing is requested separately.
5. Garmin and Other Connected Health Data
Connecting Garmin is optional. Where the feature is enabled, you authorise Garmin to provide supported information to Perform72 and separately give explicit consent for Perform72 to use health information. We explain the information and purpose before you opt in. We record the consent wording, scope and time and any later withdrawal.
Depending on the enabled connection and the categories you authorise, data may include steps and activity, heart rate, sleep, stress and calories. We may also receive the identifiers needed to link your account, measurement dates and synchronisation information. Any historical import or additional category, such as Body Battery, HRV, respiration or workout summaries, must be explained before it is enabled; this policy is not permission to collect every metric available from Garmin.
We use authorised information to show health and fitness trends, help you understand physical preparation alongside your golf record, and support the personalised golf preparation insights you choose to use. Readings and derived insights may be incomplete or inaccurate. They provide general fitness and coaching information, not medical diagnosis or treatment.
Garmin controls its own account and device services under its own terms and privacy policy. Disconnecting Perform72 does not delete information held independently by Garmin. Other connected providers likewise have their own notices.
6. Optional Sharing with a Coach
A coach does not automatically gain access to your connected health information. We ask for separate explicit consent identifying the selected coach, the categories to be shared and the coaching purpose. You may stop this sharing without ending your Garmin connection or unrelated coaching features.
A coach or academy may be a separate controller for its own records and decisions. Where that applies, its identity and privacy information must be provided before sharing. Withdrawing Perform72 sharing stops further access through Perform72; you can also contact the coach about copies it lawfully holds independently. We assist with applicable rights requests.
7. Withdrawal Disconnection and Deletion
You can withdraw health-data consent, stop coach sharing or request deletion at any time by emailing info@perform72.com. The connection or sharing feature also explains any available in-app control. Where consent is given in the app, withdrawal must be available just as easily. Revoking access through the connected provider stops future imports when the revocation is received and processed.
Disconnecting a data source stops future imports; it does not by itself mean that you want to erase a previously imported history that you have separately chosen to keep with continuing consent. You may expressly request withdrawal and deletion together. If there is no continuing valid consent, we stop consent-based use and erase the health information and identifiable derived outputs unless a specific lawful exception permits retention.
Withdrawal does not affect the lawfulness of earlier processing. We do not switch to another lawful basis simply to continue the same consent-based use. If we must retain limited information for a legal obligation or legal claim, we explain the applicable basis and restrict its use; health information also requires an applicable Article 9 condition.
8. Insights Profiling and AI
Perform72 may calculate scores, trends and personalised suggestions from your golf records and assessments. Including health information in these insights requires the health-data consent covering that use. Scores and suggestions support your choices and discussions with a coach; they are not a guarantee of a health outcome or golf score.
Garmin health information is not used for targeted advertising, advertising measurement or training general-purpose AI models. If an optional AI feature will analyse your health information, we explain its purpose, data categories, provider and handling before enabling it, and obtain the necessary separate explicit consent. We do not enable that use unless the Garmin agreement permits it.
Our coaching insights are not used to make solely automated decisions with legal or similarly significant effects on you. If we introduce such decision-making, we provide the required information and safeguards before it begins.
9. Who Receives Information
We do not sell or rent personal information, including Garmin information, or disclose health information to data brokers or advertising platforms. Authorised staff may access information where needed to operate the service or respond to your request, subject to access restrictions.
Providers supporting hosting, storage, maintenance, security and customer support may process information on our instructions under appropriate contracts. An AI provider receives health information only under the conditions in section 8. Coach access follows section 6. We may also disclose information where law requires it or where necessary for a legal claim, subject to applicable safeguards and any additional conditions for health information.
10. How Long We Keep Information
We retain account and golf records while needed to provide the account, coaching history and features you request. We assess continued need using account activity, the service relationship, your deletion instructions, outstanding support matters and applicable legal duties. We delete or irreversibly anonymise information when these purposes no longer justify keeping it; an inactive account does not justify indefinite retention.
Connected health information and health-derived insights are retained only while needed for the history and features you choose and while valid consent continues. Withdrawal and deletion are handled as described in section 7. Consent and withdrawal records may be retained separately for the minimum period needed to demonstrate lawful handling and address relevant claims, without continuing routine health analysis.
Where deleted information remains temporarily in disaster-recovery backups, it is excluded from routine use and expires through the backup replacement cycle. If a backup is restored, applicable deletion instructions are reapplied. We can explain the retention criteria and applicable backup handling for your request; any lawful reason for keeping information longer is assessed and explained.
11. International Transfers
Use of providers or an authorised coach outside the UK or EEA can involve international transfers. We disclose the relevant recipient, destination and transfer arrangement where applicable. You can request details and a copy of relevant safeguards from info@perform72.com, subject to necessary redactions.
Where transfer rules apply, we use a valid adequacy arrangement or appropriate contractual safeguards and any required assessment or additional measures. These may include the UK International Data Transfer Agreement or UK Addendum, and EU Standard Contractual Clauses where EU GDPR applies.
12. Security
We use technical and organisational measures appropriate to the risks of the information we handle, including protection during transfer and storage, access restrictions and arrangements for maintaining and reviewing security. Health information requires particular care, including limiting access and unnecessary disclosure through logs or analytics. No internet service can guarantee complete security.
13. Your Rights and Complaints
Depending on the applicable law and circumstances, you may request access, correction, erasure, restriction or a portable copy of your information, and withdraw consent. Email info@perform72.com or write to our registered office. We may reasonably verify your identity or your authority to act for another person. We respond without undue delay, normally within one month, subject to lawful extensions or pauses.
Right to object: You may object to processing based on legitimate interests and to direct marketing. We stop direct marketing when you object. Other objections are considered under the applicable legal test.
You can complain to us using the contact details above. We acknowledge data protection complaints within 30 days, investigate and keep you informed, and provide an outcome without undue delay. You may also complain to the UK Information Commissioner at https://ico.org.uk/make-a-complaint/ or an applicable local supervisory authority.
14. Junior Users and Authorised Representatives
Where junior accounts are offered, information and choices must be explained in an age-appropriate way. Connected health features require valid consent from a person with the necessary capacity or an appropriately authorised parent or guardian where law requires it. We do not enable a junior health connection if valid consent and permitted access cannot be established.
A parent, guardian or coach does not automatically gain unrestricted access to a junior’s health information. Access must reflect the junior’s rights, applicable law and the authorisation for that feature. We verify authority when someone makes a request on another person’s behalf.
15. Marketing Cookies and Similar Technologies
Marketing preferences are separate from health-data consent. Where law requires consent for electronic marketing, we request it; where another permission applies, we use it only within its limits. You can unsubscribe from marketing messages or contact us at any time. Essential service and security messages may still be sent.
Our website and app may use cookies or similar technologies. We provide information about their purpose and duration and seek consent where required before using non-essential technologies. Where a statutory exception applies, we meet its conditions, including any required information and objection option. Health information is not supplied to advertising or tracking tools.
16. Changes to This Policy
We update this policy when our services or data practices change and identify the revised date. We provide notice of material changes through appropriate channels, such as the app or email. If a new purpose or health-data category needs consent, we request that consent before the new processing begins. Continued use alone is not explicit health-data consent.
